The prosecution and defense are awaiting medical records in the case of a Farmington man accused of bludgeoning his mother.
The defense for Brian Stover, 61, told the judge that Lovelace Hospital in Albuquerque has failed to turn over the medical records for Celia Stover despite a subpoena being issued on June 8.
“If you’re having trouble, I am not keen on my orders being ignored,” District Judge Curtis Gurley said during a June 29 status hearing in the 11th Judicial District Court.
Gurley pointed out that both Defense Attorney Ian Jump and the San Juan County District Attorney’s Office has needed those records since a March 10 pretrial detention hearing.
“Please let the court know if they are disobeying the subpoena,” Judge Gurley said.
Stover was charged with aggravated battery with a deadly weapon in a Feb. 23 attack on his mother, Celia Stover, in the home they share in the 1400 block of York Avenue in Farmington.
Celia reportedly was bludgeoned with a hammer and suffered “a fractured skull.” She was treated and San Juan Regional Medical Center and then flown to Albuquerque for additional treatment, according to the affidavit for arrest warrant.
Jump told the court he had everything from San Juan Regional. It was just the records from Lovelace that had not been turned over. The DA’s office reported the same.
Once the records are received, Jump told the court he will “request pretrial interviews and see if the state if willing to make an offer.”
Stover has been held in the San Juan County Detention Center on a pretrial detention hold, since his Feb. 23 arrest. The DA’s office in their motion stated that he has a pending criminal case for aggravated battery against a household member and prior convictions for child abuse and possession of a controlled substance.
His previous child abuse conviction was “intentional” and “violent in nature,” resulting in Stover breaking “the leg of a minor,” according to the motion.
Judge Gurley set another status conference for 9 a.m. Aug. 31 in his courtroom in Aztec.
